Special terms for rental monitoring
1. General
1.1 The agreement between HomeSpotter (Growth Stories LTD, C92959, Northlink Business Centre, Level 2, Burmarrad Road Naxxar, NXR 6345, Malta) and you regarding the rental monitoring service (the "Agreement") consists, in addition to these Special Terms, of HomeSpotter's general terms, any order terms, and the price list in effect at any given time.
1.2 The definitions of words and concepts used in the general terms shall also apply to these Special Terms.

2. The Service
2.1 The service enables you to receive notifications about available apartments in Stockholm and surrounding municipalities, with the intention of obtaining an apartment in these areas.
2.2 The service does not guarantee that the user will obtain an apartment. It is up to the user to express interest in a chosen apartment listing and to meet the specific landlord's requirements.
2.3 A discount on the monthly fee may be granted to you if your referral of HomeSpotter leads to a new user subscribing, as well as to the user who was referred. If you were referred, you receive a discount from month one (1). If you made the referral, you receive a discount after payment from the referred user has been received no later than the last day of month two (2). Discounts are only granted when your subscription is active, meaning your subscription is not paused, terminated, or blocked due to unpaid monthly fees. If you pause your subscription or if HomeSpotter is unable to charge the monthly payment from your debit or credit card, you will not be granted a discount. A discount is also not granted to you if you referred the user in question in such a situation.
3. Delivery of the service
3.1 Since the agreement has been entered into at a distance, the service is delivered the moment the order is completed.
3.2 As the service takes effect the moment the order is placed, you also give your consent that the service has commenced and thereby the right of withdrawal ceases in accordance with the Distance Selling Act.
4. Responsibility for information, etc.
4.1 HomeSpotter is not in any way responsible for information that passes to or from the Internet via HomeSpotter. HomeSpotter is also not responsible for material and information that you or another person communicates, publishes, or stores via or on HomeSpotter's website. You are therefore solely responsible for correspondence, posts in discussion forums, social media, and other internet activities in which you participate. Information in these Special Terms refers to audio, images, text, data, and video as well as links to other websites. HomeSpotter is also not responsible for the content of calls or messages to the landlord that you make through the service.
5. Compensation for errors or service interruptions
5.1 If the service is affected by errors or outages that prevent you from using the service, you are entitled to a deduction in proportion to the duration of the error or outage, calculated in full days from the time the error or outage was reported to HomeSpotter. If the error or outage has lasted at least:
- five (5) consecutive days, a deduction of twenty-five (25) percent of the fixed fee for one (1) month is made;
- ten (10) consecutive days, a deduction of fifty (50) percent of the fixed fee for one (1) month is made;
- fifteen (15) consecutive days, a deduction of one hundred (100) percent of the fixed fee for one (1) month is made.
6. Compensation and payment
6.1 There are three payment options: direct debit from a payment card, bank account, or invoice payment. It is the user's responsibility to ensure that their type of payment card is supported. You choose your own payment method and can switch to another payment method at any time, which will take effect from the next payment occasion. We use a third-party payment service provider as indicated in the order flow from time to time. Invoice payment requires approved credit check. All transactions are sent via SSL (Secure Sockets Layer) for security and are encrypted. Payment and credit card details for card purchases are handled by the payment service provider. HomeSpotter only works with payment service providers certified according to the PCI-DSS (Payment Card Industry Data Security Standard) security requirement. You are responsible for ensuring that the information you provide is correct. You also undertake to follow the instructions that HomeSpotter or the Internet bank provide at any given time.
6.2 Billing normally occurs on a monthly, quarterly, semi-annual, or annual basis depending on which plan you have ordered. For invoices, payment must reach the payment service provider no later than the invoice due date. You are responsible for ensuring sufficient funds are available for payment via card or direct debit from a bank account. If there are insufficient funds on your payment card or account, an automatic assessment is made by the payment service provider as to whether the fee can be sent as an invoice. While awaiting payment, HomeSpotter has the right to pause or terminate the user's account without notifying the user in advance.
General Terms
The following general terms apply between HomeSpotter operating through the wholly owned brand HomeSpotter ("HomeSpotter") and any individual who subscribes to one or more of HomeSpotter's services for private individuals ("you/your").
1. General
1.1 The agreement (the "Agreement") consists of (i) any specific terms for the service regarding prices and other matters that HomeSpotter delivers to you in connection with your order (see definition below) ("Order Terms"), (ii) the special terms that apply to ordered services ("Special Terms"), (iii) these general terms, as well as (iv) the price list in effect at any given time. In the event of any conflicts in the contractual documents, they take precedence in the following order: 1. Order Terms, 2. Special Terms, 3. General Terms, 4. the price list in effect at any given time. Information about HomeSpotter's processing of your user data can be found in our privacy policy on the website (www.homespotter.se).
1.2 Regarding payment services, HomeSpotter's Special Terms for payment services apply. Regardless of what is stated in these General Terms or said Special Terms, HomeSpotter has no obligation whatsoever to provide payment services to you if HomeSpotter no longer provides payment services on the Swedish market or if HomeSpotter no longer has authorization to provide payment services.
1.3 The Agreement shall be deemed to have been entered into when you have ordered the service (the "Order"), by filling in an order form on HomeSpotter's website.
1.4 The General and Special Terms and price lists in effect at any given time are available on HomeSpotter's website.
2. Right of withdrawal
2.1 You have the right to withdraw from the Agreement within fourteen (14) days from the day you ordered the service by notifying HomeSpotter via www.HomeSpotter.se. HomeSpotter will send a confirmation that the message has been received.
2.2 In accordance with the Distance Selling Act, you have forfeited your right of withdrawal at the time you began using the service. As delivery of the service commences simultaneously with the order being completed, you agree that your right of withdrawal has been consumed and that only HomeSpotter can decide on any exceptions.
2.3 If you wish to exercise your right of withdrawal, you must notify HomeSpotter no later than fourteen (14) days after your notice of withdrawal. HomeSpotter uses the same payment method for the refund as you used for the payment.
2.4 Upon withdrawal, you must compensate HomeSpotter for
- (a) any delivery costs beyond standard delivery costs,
- (b) depreciation of a service if you have used it to a greater extent than was necessary, and
- (c) such part of the service that was performed before you withdrew.
2.5 By entering into the agreement, you consent to the service being performed during the withdrawal period and that the right of withdrawal does not apply if the service has been fully performed. You also consent that the right of withdrawal is lost if you have started using the service, or if the purchase concerns digital content delivered by means other than on a physical medium.
3. Prerequisites for the Agreement
3.1 HomeSpotter reserves the right to, in connection with or after the agreement has been entered into, carry out a check on you as a user to determine that you are responsible for your own finances, i.e., are not declared legally incompetent, that you are 18 years or older, and that you have a Swedish personal identity number. If this check reveals that you do not meet any of the requirements or that there are strong reasons to believe that you will not comply with the terms of the agreement, HomeSpotter has the right to terminate the agreement with immediate effect within a reasonable time from the date the agreement was entered into. If HomeSpotter terminates the agreement pursuant to this section, you are not obligated to pay any monthly fee for the service.
4. Delivery of service
4.1 The service is deemed delivered from the time of order regardless of when the user chooses to start using the service. The delivery time for the service is specified in the Order Terms or in the Special Terms.
5. Use of service
5.1 You are obligated to follow HomeSpotter's instructions and applicable laws and regulations when using the service.
5.2 You are responsible for your use of the service. You may not use the service in any way other than customary or in a way that causes damage or other inconvenience to HomeSpotter or others. Prohibited use under this section includes, but is not limited to, the following:
- (a) using the service in a way that exceeds limitations in the agreement or, if no such limitation is specified, using the service in a way that very significantly deviates from the average usage of all HomeSpotter users of the corresponding service;
- (b) using the service in a way that must be considered abuse of the service; or
- (c) using the service for purposes other than personal use (e.g., by using the service in organizations or communities, in business operations, or for resale or other commercial purposes).
In the event of use of the service in violation of this section, HomeSpotter reserves the right to take reasonable measures against you as a user. Such measures may consist of restrictions on the use of the affected service, such as HomeSpotter wholly or partially suspending the affected service.
HomeSpotter's right to take measures under this section shall not affect HomeSpotter's right to also invoke other remedies due to your breach of contract.
5.3 The service is personal and may not be shared with another individual. Should this be violated, HomeSpotter has the right to terminate the service with immediate effect without notifying the user.
5.4 If you become aware that the service is being used in violation of sections 5.1-5.3, you shall immediately take corrective action and inform HomeSpotter of the violation.
5.5 Unless otherwise specifically stated in the agreement, you shall compensate HomeSpotter for any damage that you, or another for whom you are responsible, intentionally or through negligence cause HomeSpotter through breach of the agreement.
6. Service quality, support, and maintenance
6.1 Information about minimum quality and terms for support and maintenance of the services is specified in the Order Terms and/or in the Special Terms for each service.
6.2 For support and maintenance needs regarding the services, you may, unless otherwise agreed, contact HomeSpotter via HomeSpotter's website.
7. Compensation and payment
7.1 You shall pay HomeSpotter fixed and variable fees in accordance with what is stated in the Order Terms and/or Special Terms for each service and the price list in effect at any given time, unless otherwise agreed.
7.2 Fixed fees are charged in advance and variable fees are charged in arrears. Billing for fixed fees occurs monthly, quarterly, semi-annually, or annually depending on the plan you have ordered. All prices, stated in SEK, include VAT unless otherwise specified.
7.3 There are three payment options: direct debit from a payment card, direct debit, or invoice payment. It is the user's responsibility to ensure that their type of payment card is supported. You choose your own payment method and can switch to another payment method at any time, which will take effect from the next payment occasion. We use a third-party payment service provider as indicated in the order flow from time to time. Invoice payment requires approved credit check. You are responsible for ensuring sufficient funds are available for payment via card or direct debit from a bank account. If there are insufficient funds on your payment card or account, an automatic assessment is made by the payment service provider as to whether the fee can be sent as an invoice. While awaiting payment, HomeSpotter has the right to pause or terminate the user's account without notifying the user in advance.
7.5 In the event of late payment, if the delay is material, after HomeSpotter's notice thereof, accrued fees and other charges for all services become due for payment.
7.6 If you have objected to a payment within a reasonable time and stated factual grounds for the objection, HomeSpotter shall, at your request, grant reasonable respite for payment of the disputed amount until HomeSpotter's investigation has been completed or the dispute has been finally resolved. During the respite period and until payment is made, HomeSpotter is entitled to late payment interest in accordance with the Interest Act on that part of the disputed amount that you ultimately become obligated to pay.
8. Errors or service interruptions, limitation of liability, etc.
8.1 If the service is affected by errors or outages that prevent you from using the service, and the error/outage has not been caused by any circumstance on your side, you are entitled to a deduction in proportion to the duration of the error or outage, calculated in full days from the time the error or outage was reported to HomeSpotter. The deduction is made in an amount corresponding to the current service's fixed fee during the duration of the error or outage, unless otherwise stated in the Special Terms. Deductions of less than 25 SEK per billing period are not paid out.
8.2 HomeSpotter is only liable for direct damage that HomeSpotter, or someone for whom HomeSpotter is responsible, has caused you through negligence. HomeSpotter is not liable for indirect damage or loss, such as lost profits or other consequential damages. HomeSpotter is also not liable for damage arising from the content of data or other information transmitted through the use of the service, for damage caused by computer viruses or similar, for loss, delay, or corruption of data or information, or for your potential liability to third parties. The limitations in this section do not apply in cases where HomeSpotter has acted intentionally or with gross negligence.
8.3 HomeSpotter is exempt from liability for breach of the agreement caused by events beyond HomeSpotter's control, the consequences of which HomeSpotter could not reasonably have controlled, e.g., war, acts of war, explosion, severe weather, general energy shortage, power outages, government actions or government failure to act, new or changed legislation, labor market conflicts, and comparable circumstances.
8.4 HomeSpotter has the right, for technical and/or operational reasons, to perform maintenance of the services, the Network, or related equipment, which measures shall as far as possible be scheduled during nighttime to reduce the risk of any disruptions. Such planned maintenance does not constitute grounds for compensation under this section 8. For extensive planned maintenance work, you shall be notified in advance.
8.5 Your claim for compensation under the agreement must, in order to be enforced, be submitted within a reasonable time from the discovery or expected discovery of the damage. A reasonable time shall normally be considered to be three (3) months.
9. Contract period and termination
9.1 The Agreement is valid until further notice and can be terminated at any time without notice period. Termination is done by logging in to homespotter.se and clicking Terminate. The Agreement then ceases to apply after the last day of the period in which the termination occurs. You pay your fee in advance, which means you do not pay any further fee after terminating the subscription, with the exception of any extra services you have purchased, as these services are charged in arrears. Upon termination from HomeSpotter's side, you may request that it be done in writing.
9.2 The Agreement can also be terminated in writing by contacting customer support at kontakt@homespotter.se. Written termination must then be received in reasonable time before the next period is renewed to give customer support a reasonable chance to terminate the agreement. A reasonable period in this case is considered to be five (5) business days.
9.3 Even if you terminate the agreement before HomeSpotter has charged the first fee, you are always obligated to pay said fee.
9.4 HomeSpotter has the right to terminate the agreement, or block certain services or part of or certain functions of a service, with immediate effect and until further notice if:
- (a) You breach the agreement or use the service in violation of what is stated under section 6, or damage occurs to HomeSpotter or others, or you otherwise clearly abuse the service;
- (b) You mismanage your payments, initiate composition negotiations, enter into liquidation, upon check pursuant to section 3 (which HomeSpotter has the right to conduct continuously during the contract period), do not provide HomeSpotter (taking into account your use of the service) with security requested at any given time for the fulfillment of its obligations under the agreement, or
- (c) there are strong reasons to believe that you will not fulfill your obligations under the agreement.
9.5 For HomeSpotter to block the service due to actual or suspected breach of the Agreement, you must first be asked to cease the breach within a reasonable time and be notified that the service may otherwise be blocked. However, this does not apply if you have repeatedly made late payments, in which case HomeSpotter has the right to block the service without providing such notice. To the extent that blocking of the service occurs during the current contract period, you are not exempt from payment obligations during the blocking period.
9.6 Upon termination from your side, you are only entitled to a reduction or refund of the fixed fee paid in advance if you terminated the agreement because HomeSpotter changed the contract terms in a way you do not accept. The right to reduction or refund does not apply to prepaid fees that you have paid after being notified of the change in terms.
9.7 Termination of an agreement regarding one service shall not mean that these general terms are terminated regarding other services for which you have entered into an agreement.
10. Transfer of the Agreement
10.1 HomeSpotter has the right, without your consent, to wholly or partially transfer or license its rights or obligations under the agreement to another company within the same group or to a third party who, itself or through a subcontractor, can reasonably be expected to fulfill its obligations under the agreement in a satisfactory manner.
11. Amendment of terms
HomeSpotter has the right to make changes to the agreement. Changes that are not clearly to your advantage will be communicated via SMS and/or email at least one month before the change takes effect. In such cases, you have the right to terminate the agreement. If you continue to use the services after the change takes effect, HomeSpotter interprets this as your acceptance of the change.
12. Notices
12.1 Notices in connection with the agreement shall be made by email or via HomeSpotter's website.
12.2 Email sent to your specified email address shall be deemed to have reached you on the same day it was sent.
12.2 SMS sent to the specified phone number shall be deemed to have reached you on the same day it was sent.
12.4 Letters sent to the most recently provided address of the other party shall be deemed to have reached the receiving party on the seventh day after dispatch.
13. Disputes
13.1 Disputes regarding the application or interpretation of the agreement or related matters shall primarily be resolved through negotiation and agreement between the parties.
13.2 Any dispute may be reviewed by the National Board for Consumer Disputes (www.arn.se Kungsholmstorg 5, 101 23 Stockholm). HomeSpotter always follows the National Board for Consumer Disputes' recommendations.
